Official Mugs Terms & Conditions

It is illegal to reproduce unlicensed trademarks or logos onto products within the officialmugs.co.uk site. The exclusive use and reproduction of such images lie solely with the legal owners. In addition, unlicensed copyrighted material from photographers, artists, authors and writers of original works, cannot be reproduced within the officialmugs.co.uk web site.

Privacy, security and confidentiality are important to Officialmugs.co.uk. The following terms and conditions endeavour to make our web site a safe place to trade. You should understand that by using this web site you agree to the following terms and conditions.

1) Payment Terms
Payment shall be made in full when placing your order, unless special settlement terms have been agreed by us in writing. By placing an order using a credit card over the internet you are agreeing to these terms and conditions.

2) Passing of title and risk
The risk of the goods shall pass to you on delivery of that order.
All goods, delivered or not, remain our property until payment is received in full. Until such time as payment in full is made by you shall retain such goods separately from other goods and clearly mark them in such a way that they can be readily identified as being our property and any payment received by you for any sale of such goods must be held in a separate account in trust for us. In the event of non-payment by you for such goods we will, without loss of any rights or remedy, remove from your possession those goods belonging to us in accordance with these terms and conditions and we shall be entitled upon the property where the goods are stored and repossess and remove the same. You hereby grant us irrevocable licence to enter your premises for the said purpose.

 3) Variations
We reserve the right to alter any details or design of products illustrated without prior notice and while every effort is being made to describe goods accurately on this website no warranty is given as to accuracy and no responsibility will be accepted for error or mis-description and any resulting loss. Variations may vary, without any liability, to the content of the site, including quotations, sales literature or other documents as long as such alterations do not materially affect the quality of the goods.
All products are printed by hand, as such we shall endeavour to match the colour, style and positioning on each item however we are unable to guarantee an exact match.

4) Quotations
Quotes are valid for a period of 30 days unless otherwise agreed in writing by us. A quote is a separate agreement between us and the customer and as such the customer is not entitled to any further discount as advertised on the website.

5) Contracts
All prices quoted on the website are in British Pounds Sterling and are inclusive of postage within the British Isles with the exception of quoted orders which shall illustrate a unit and courier cost. This cost shall be quoted to the customer prior to acceptance.
We are entitled to increase the price of goods at any time prior to printing the product(s) due to factors beyond our control, however once the product(s) has been printed we will honour the price as per the email agreement with the customer.

6) Payments
The customer shall pay for all goods prior to print and dispatch due to the personalised nature of trade unless otherwise agreed in writing between us and the customer.
Should an agreement be accepted between us and the customer, we are entitled to invoice the customer for payment on or at any time after dispatch of goods.
The customer shall make payment without deduction or setoff within 30 days of the date upon the invoice. Payment is to be made either by cheque made payable to ‘Mymugshot’ or using the secure online server within our website.
In making payment the customer is within agreement that they are the account holder and that sufficient funds are held to honour the payment.

7) Overdue cheques 
No goods will be delivered on accounts which remain unpaid 30 days after payment is due. Interest will be charged on overdue accounts, at the rate of 5% above the Bank of England base rate from time to time from the date the account became due until payment is received. This does not prevent us from pursuing payment of overdue accounts at any time after payment becomes due and shall be in addition to and without prejudice to any other rights we may have against you.
We reserve the right to charge you for any legal or collection charges where it is necessary to obtain payment from you of an overdue account through a third party or Court proceedings.

 

8) Delivery and lead times
Any dates provided for delivery are approximate only, and we are not responsible for the timely receipt of goods once dispatched to the customer. As such, late deliveries will not be refunded, and payment will be pursued due to the personalised nature of our products.
Please note the next day print and dispatch service is currently only applicable to gift orders, and is offered at the discretion of us.
Orders not received within 7 working days of dispatch must be reported to us by email. Failure to notify us within this period may result in us not accepting any responsibility for items dispatched and not delivered/received.

9) Delivery Cost
The cost displayed throughout the site includes the cost of postage within the British Isles with the exception of quoted orders which shall be quoted to illustrate unit and courier costs, this cost shall be quoted to the customer prior to acceptance. Costs for delivery outside the UK shall be calculated in accordance with point 12 of these terms. Orders will be dispatched using Royal Mail or for larger parcels a Courier at the discretion of us. Goods returned to us described as undeliverable, will be subject to a redelivery charge.

10) Overseas Delivery
Postage outside the UK will be calculated dependent upon the weight of the products ordered. For small orders these costs shall be calculated during the checkout process. For larger orders a quote is available upon request. Parcels leaving the British Isles shall be identified with a customs label identifying the contents of the parcel. This may be examined by customs.
  
11) Quantity variations
We shall be deemed to have fulfilled our contract by delivery of a quantity within 5% plus or minus of the quantity of printed goods ordered and you will be charged at the contract rate for the quantity delivered.

12) Claims
Claims arising from damages must be reported to us within 48 hours of delivery by email, failure to do so and we will not accept responsibility and the customer shall not be entitled to reject the goods.

You must examine all goods delivered at the time of delivery. We shall not be liable for any loss or damage caused arising from damage caused to the goods in transit unless loss or damage is noted at the time of delivery to us by E-mail. In the case of mugs arriving broken a photo of the broken mug, clearly displaying the image must be provided before a replacement is dispatched.
Claims in respect of non-delivery must be made in writing within 14 days of order and will only be accepted if the “special delivery” option has been chosen. No claims for non delivery can be made if the “royal mail” option has been used.

13) Cancellation charges or product dissatisfaction.
No goods are sold to the customer on a sale or return basis. The customer has no right to reject or return the goods without the consent of us. As goods are personalised a 'cooling off' period is not applicable. Personalised items of clothing may not be exchanged or refunded should the customer request an incorrect size at time of order. Your statutory rights are not affected.

14) Quantity changes to orders
Any changes in quantity ordered must be made by E-mail to us prior to commencement of processing. Any increase in the order must be regarded as a separate contract unless written notification is received before work commences on the original order.

15) Alterations
We shall endeavour to make amendments to requested orders as timely as possible. However if this request is received after the product has been printed we shall not be liable for the cost of a reprint.

16) Artwork and printing
We will endeavour to match colours as closely as possible. Exact colour matching onto different substrates is not always possible and we are unable to guarantee an exact match. As such the customer has no right to reject or return the goods on these grounds. Should the customer have concerns regarding the colour match on multiple orders of the same design we recommend that a sample mug is obtained from the resellers site, to proceed without a sample is at the sole risk of the customer. All products are printed by hand, as such we shall endeavour to match the colour, style and positioning on each item however we are unable to guarantee an exact match.

17) Images
We do not accept responsibility for the quality of images sent to us, 'the higher the quality of image the better the print'.
 Licensed or copyright images, logos or trademarks must not be submitted to us by the customer for reprint without the consent of the owner. We shall not be liable for any claim or expense arising out of any illegal or libellous matter printed for the customer or any infringement of copyright or patent or similar right resulting from compliance of the customers instructions either expressed or implied. Any legal costs incurred in such matter shall be borne by the customer.

18) Design and Layout
We offers an On Line Design Service that is designed to provide the customer with the opportunity to view an illustration of their image on our products. We shall then resize the image to provide the customer with a product of optimal quality. We accept no responsibility for poor quality images submitted to us. The better the image supplied to us the better the print.

19) Errors arising
We do not accept responsibility for customer input or spelling mistakes on orders. We do not accept responsibility for errors on larger orders once a printing proof has been accepted by email with the customer.

20) Liability
Except in the case of death or personal injury caused by negligence on behalf of us, we will not be liable to the customer by reason of any representation, implied warranty, condition or other term, or any duty at common law, or under the express terms of the conditions for any consequential loss or damage (whether for loss or profit or otherwise), costs, expenses or other claims for consequential compensation whatsoever which arise out of, or in connection with the supply of the goods or their use or resale by the customer.

21) Website Liability
Whilst we endeavour to keep the website and emails free from viruses, Trojans, worms and any other similar such ailments, we shall not be liable to the customer or site visitors for any destructive results.

22) Large orders
Where you require a quantity larger than shown, this is possible. Please contact for an exact quotation at sales@officialmugs.co.uk.

23) Force majeure
We will not be held responsible for failure or delay in the carrying out of our obligations under the contract arising out of any cause outside our reasonable control or by inability to procure materials or articles except at higher prices due to any such cause and in such circumstances we shall be entitled by notice to terminate the contract in whole or in part without incurring any liability to you.

24) Jurisdiction
Any contract formed under these conditions of sale shall be construed and enforced in accordance with English Law in the Courts of England and Wales.

25) Testimonials
We reserve the right to reproduce testimonials or statements sent to us by customers for the purpose of furthering our sales. No contact details will ever be used and the privacy of our customers is paramount at all times.


26) Medical perspective
Although the mug will be dishwasher safe from a medical perspective some dishwashers and some detergents may combine to slightly fade the photo on the mug over time. Therefore we recommend you do not use a dishwasher with this product.
